BOARD OF ZONING APPEALS

          Mrs. Thomas-Roth called the Board of Zoning Appeals meeting to order.  Attendance was taken.  Mayor Goudy and Mr. Bruns were attending a City of Union budget meeting and were not at the Board of Zoning Appeals meeting.

Mr. Applegate was present during the first part of the meeting to tell the board that the staff had no objections to both of the applications for variances.

1.      Mrs. Thomas-Roth asked if there were any corrections or additions to the minutes from the October 7, 2008 meeting.  There were no corrections so Mr. Marsh moved that the minutes be accepted as prepared.  Mr. Butler seconded the motion.  All concurred and the minutes were accepted as prepared.

2.      Application for a zoning variance in the rear yard for Edward and Diana Starnes, 103 Deans Circle for a sunroom that will extend into the rear yard requirement.

Mr. Marsh noted that there was an error on the agenda and that this request for a variance was for building a "sunroom" instead of a "shed" as listed on the agenda.  He asked that be corrected for the record. 

Property owner Eddie Starnes was present at the meeting.

Mr. Marsh noted that the sunroom was in the rear of the property adjacent to a green space so the structure would not affect any of the neighbors.

The board had no objections to the structure so Mr. Marsh moved that the variance be approved.  Mrs. Thomas-Roth seconded the motion.  All concurred and the variance was approved.

3.      Application for a zoning variance in the building setback for Nicholas Albert, 622 Beery, for a deck on the front of the house.

Property owner Nicholas Albert was present at the meeting.

Mrs. Thomas-Roth said she understood that some of the original stoops or concrete steps on the houses in that neighborhood were needing to be replaced and that the addition of the deck would improve the appearance of the property.

Mr. Marsh asked if Mr. Albert had checked with his neighbors to see if they had any objections to the deck.  Mr. Albert said he had not talked to the neighbors concerning this. 

Mr. Marsh said he had no objections to the deck but asked if Mr. Albert came back with something like this in the future, if he would check with his neighbors first.  He said he just wanted to keep everyone in the city happy.

Mr. Marsh moved that the variance request for the deck be approved.  Mrs. Thomas-Roth seconded the motion.  All concurred and the variance was granted.

4.      Mrs. Thomas-Roth moved that the Board of Zoning Appeals meeting be adjourned.  Mr. Marsh seconded the motion.  All concurred and the meeting was adjourned.
