          The City of Union council meeting was called to order by Mayor Goudy on September 13, 2010 at 7:30 p.m. on Monday.


          Attendance was taken and the following council members were present:  Mr. Bruns, Mrs. Oberer, Mrs. Kyle, Mayor Goudy, Mr. O’Callaghan, and Mr. Blackwell. 


          Other city staff members present were John P. Applegate, City Manager, Denise Winemiller, Clerk of Council, and Joe Moore, Law Director.


          Mayor Goudy called for a moment of silence.


          1.       Mayor Goudy asked if there were any additions or corrections on the minutes from the August 9, 2010 council meeting.  There were no corrections mentioned so Mr. O’Callaghan moved that the council minutes be accepted as prepared.  Mr. Bruns seconded the motion.  All concurred and the August 9, 2010 City of Union council minutes were accepted as prepared.


          Mayor Goudy said that Mrs. Perkins was out of town on business so she moved that Mrs. Perkins’s absence be excused.  Mr. Bruns seconded the motion.  All concurred and the motion was passed.


          2.       There were no comments from the citizens and visitors in the audience.




          Mayor Goudy read the proclamation requested from Five River Metro Parks and she signed the proclamation to show her support.


          4.       Setting a date for a public hearing on a zoning text amendment.


          Mr. Applegate said information concerning this had been outlined in a memorandum distributed to the council.  Mr. Applegate said they have a recommendation from the Planning Commission to amend a portion of the Union code under the extraction of sand and gravel and other minerals, to include concrete ready-mix plants.  Mr. Applegate added that the old Miller Brother’s plant had been purchased by Phillips and under the current code, they would be excluded.  The business was allowed because it was a pre-existing use when annexed but in purchasing the property they are requesting that their business be allowed in the Union code.  The planning commission and staff were in agreement about adding to the code and they would like to set a public hearing date of October 25.  This addition would be under the conditional use in Agricultural-Residential zoning.  Mr. Bruns said that this was brought up and discussed by the Planning Commission and they were in favor of a zoning text change.


          Mr. Bruns moved to set a public hearing date of October 25, 2010 for a public hearing on a zoning text amendment to the City of Union code, 1145.01, Agricultural-Residential.    Mr. Blackwell seconded the motion.  All concurred and the motion was passed.


          5.       Open Agenda


          Mayor Goudy asked how the parking area behind the city building was progressing.  Mr. Applegate said the project was going quite well.  They have placed the order for the fence and it has come in.  Two benches have been ordered and Wagner Paving was to be in the following week to pave the alley.  A new utility payment drop box will be installed and the old one will be removed.

          Mr. Applegate said that once that was done, they would be going out for bids to paint the water tower on Shaw Road.  Mr. Applegate said he was not sure if they could get the tower painted yet this year but once  the Shaw Road tower is painted, the tower behind the city building will come down. 


          Mayor Goudy then asked about the resurfacing of the old basket ball court area.  Mr. Applegate said they were working on that.  The benches are in for the new basketball court and some bleachers would be put in.  Next spring, they will add a volley ball court.


          Mr. Blackwell asked if they would be resurfacing any streets this year.  Mr. Applegate said there would be a few streets done but they were behind this year.  He wasn’t sure if they could get in the slurry seal this fall.


          Mr. O’Callaghan asked when the start date would be for the leaf pickup.  The date is set for October 12. 


          Mrs. Kyle said she showed her daughter the new water tower on Old Springfield Road and her daughter could not believe how much Union has grown.  She thought they were doing a great job.  Mr. Applegate said the whole staff was doing a great job.  He said the water tower on Shaw Road would have the same color and sign logo as the new one on Old Springfield. 


          6.       Mayor Goudy moved that the council meeting be adjourned.  Mr. Bruns seconded the motion.  All concurred and the September 13, 2010 City of Union council meeting was adjourned.
